1. Acceptance of Terms

By accessing or using the Nefs Abhayas website (nefsabayas.com), mobile applications, social media pages, and any related services (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Services.

These Terms constitute a legally binding agreement between you and Nefs Abhayas, a business operating in the United Arab Emirates.

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you may use our Services only with the involvement and consent of a parent or guardian. By using our Services, you represent that you meet these requirements.

3. Orders & Payment

All orders placed through our Services are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product descriptions.

Prices are listed in UAE Dirhams (AED) and are inclusive of applicable taxes unless otherwise stated. Shipping costs are calculated at checkout and are your responsibility.

Payment must be made in full at the time of order. We accept major credit cards and other payment methods as indicated on our checkout page.

4. Shipping & Delivery

We ship worldwide via DHL Express and other trusted carriers. Delivery times are estimates and vary by destination. Made-to-order pieces typically dispatch within 4–6 weeks; ready-to-wear items ship within 5 working days.

You are responsible for providing accurate shipping information. We are not liable for delays or losses caused by incorrect addresses, customs procedures, or events beyond our control.

5. Returns & Refunds

Made-to-order pieces: All custom and made-to-order abayas are final sale and non-refundable.

Ready-to-wear & accessories: May be returned within 14 days of delivery, provided they are unworn, unwashed, and in original condition with all tags attached. Return shipping costs are the customer’s responsibility unless the item is defective or incorrect.

Refunds are processed to the original payment method within 7–14 business days of receiving the returned item.

6. Intellectual Property

All content on our Services — including text, images, logos, designs, photographs, and software — is the property of Nefs Abhayas or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written consent.

7. User Content

If you submit reviews, photos, comments, or other content to our Services or social media channels, you grant us a non-exclusive, royalty-free, perpetual, and worldwide licence to use, display, and distribute that content for marketing and promotional purposes.

You represent that your content does not violate the rights of any third party and is not unlawful, defamatory, or offensive.

8. Prohibited Conduct

You agree not to:

• Use our Services for any illegal or unauthorised purpose.
• Attempt to gain unauthorised access to our systems or user accounts.
• Interfere with the security or integrity of our Services.
• Upload viruses, malware, or harmful code.
• Harvest or collect personal information of other users.
• Engage in fraudulent transactions or misrepresent your identity.

9. Social Media & Third-Party Platforms

Our Services may integrate with or link to third-party platforms, including Meta (Facebook, Instagram, WhatsApp, Messenger). Your use of those platforms is governed by their respective terms and privacy policies. We are not responsible for the content, practices, or policies of third-party platforms.

10. Disclaimer of Warranties

Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, error-free, or free from harmful components.

Product colours and appearances may vary slightly due to screen settings and photography lighting. We make every effort to display products accurately but cannot guarantee exact colour matches.

11. Limitation of Liability

To the fullest extent permitted by law, Nefs Abhayas shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of our Services shall not exceed the amount you paid for the relevant order.

12. Governing Law & Disputes

These Terms are governed by the laws of the United Arab Emirates. Any dispute arising from these Terms or your use of our Services shall be resolved exclusively in the courts of Dubai, UAE.

13. Changes to These Terms

We may modify these Terms at any time. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use of our Services after changes constitutes acceptance of the revised Terms.
